This End User License Agreement ("EULA") is a legal contract between you and MECH AI, Inc. for use of the MECH AI application ("Software"). By installing or using the Software, you agree to this EULA.

1. License grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Software on devices you own or control, subject to this EULA and the store terms where you obtained it.

2. Restrictions

No reverse-engineering, decompiling, or disassembling the Software
No sublicensing, renting, or reselling
No use to build a competing service
No removal of proprietary notices

3. Updates

We may provide updates that add, change, or remove features. Your license covers updates.

4. Ownership

The Software is licensed, not sold. We retain all rights, title, and interest.

5. Third-party services

The Software integrates third-party services (including large language model providers, Amazon Product Advertising API, and RevenueCat) whose terms may also apply to your use of related features.

6. Safety-critical use

The Software provides informational guidance. Do not use it as a sole basis for repairs involving safety systems (brakes, steering, airbags, fuel systems). Always consult a qualified mechanic for safety-critical work.

7. Termination

This EULA terminates automatically if you breach it. On termination, stop using the Software and delete all copies.

8. Disclaimer & limitation of liability

THE SOFTWARE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES. OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing law

This EULA is governed by the laws of the State of Utah, United States.

10. Apple App Store — Licensed Application End User License Agreement

For Software obtained through the Apple App Store, the following additional terms apply, and in the event of any conflict with the foregoing, these Apple-specific terms control with respect to your use of the iOS version:

Acknowledgement. You acknowledge that this EULA is concluded between you and MECH.AI LLC only, and not with Apple Inc. ("Apple"). MECH.AI LLC, not Apple, is solely responsible for the Software and the content thereof.
Scope of License. The license granted to you for the Software is limited to a non-transferable license to use the Software on any iOS or iPadOS device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
Maintenance and Support. MECH.AI LLC is solely responsible for providing any maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Software.
Warranty. MECH.AI LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Software to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be MECH.AI LLC's sole responsibility.
Product Claims. You and MECH.AI LLC acknowledge that MECH.AI LLC, not Apple, is responsible for addressing any claims relating to the Software or your possession and/or use of the Software, including (i) product liability claims; (ii) any claim that the Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights. You and MECH.AI LLC acknowledge that, in the event of any third-party claim that the Software or your possession and use of the Software infringes that third party's intellectual property rights, MECH.AI LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Beneficiary. You and MECH.AI LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
